New Client Release & Questionnaire

I, the undersigned, have enrolled myself and my dog(s) described below in private dog training sessions (“Training”) with dog behaviorist Kirk Cushing (the “Trainer”) through his company The Dog Masters, LLC (“Dog Masters”). I have signed this Dog Training Services Contract (the “Agreement”) as of the date written below. Assumption of Risks and Release of Liability. I understand there are inherent risks associated with training, socializing, walking and working with dogs generally and particularly with dogs who have behavioral issues. I assume any and all responsibility and liability for myself, any family members, friends or guests who will take part in Training sessions, and my dog(s) (collectively, the “Participants”) during Training sessions in my home, at a dog park, dog-friendly restaurant or other public space as may be agreed on between myself and Trainer. I will not hold Trainer, Dog Masters, any of their affiliates or agents or any third parties involved in a Training session, directly or indirectly, responsible for any injuries or losses sustained by Participants during a Training session. I further understand that my participation in activities during a Training session is not without risk, and I understand that even with precautions taken, Participants may trip, fall down, be knocked down, jumped on, bitten, scratched or otherwise injured during Training. I understand that in engaging Trainer to provide Training sessions with my dog(s), I am representing that my dog(s) are in good health and have received necessary vaccinations as recommended by my veterinarian and that all information provided to the Trainer on the intake form is complete and accurate. I have had an opportunity to discuss any and all concerns I have with the Trainer prior to commencement of a Training session. I hereby waive, release, and discharge any and all claims, demands, causes of action or other proceedings (“Claims”) against Dog Masters and/or Trainer, including any of their respective employees, agents, officers or other persons authorized to provide services on behalf of Dog Masters (“Released Parties”), for any injury, death or damage to or loss of personal property of Participants arising out of or in connection with participation in Training sessions by Participants, from any cause whatsoever. I further agree to indemnify, defend and hold harmless all Released Parties from any Claim, judgment, penalty, fine or other costs or expenses (including, but not limited to, attorneys’ fees and litigation expenses), including those brought by third parties, arising from, growing out of, associated with or in connection with Training, directly or indirectly, and relating in any way to my dog(s), the dog(s) of the Released Parties, any other person, dog or animal, and/or negligence or failure of Participants to follow the instructions of the Trainer or employees or agents of Dog Masters. Further, it is expressly understood that my obligation to indemnify the Released Parties is intended to indemnify and hold harmless the Released Parties from any of their own liability or negligence, including, but not limited to, their comparative, proportionate and/or joint liability and/or negligence, including liability for gross negligence and strict liability, whether or not that liability or negligence is the sole or concurring cause for the assertion of any and all Claims. I agree that this provision is intended to be as inclusive and broad as is permitted by Colorado law, and that if any portion of this provision is held invalid by a competent court, it is agreed that all other portions shall continue in full force and given full legal effect. Dispute Resolution. I agree that any dispute arising out of this Agreement will be resolved in accordance with the following sole and exclusive procedures. The parties hereby agree that if one brings any suit or action arising out of claims under this Agreement, that party shall bear all legal fees and costs, including those of the other party and any third parties joined in the claim. Negotiation. The parties shall first make a good faith attempt to resolve by dispute arising out of this Agreement by negotiation between myself and Trainer. Any person may give the other party written notice of any dispute not resolved in the normal course of business. Within ten days of receipt of that notice, the parties shall meet at a mutually acceptable time and place to attempt to resolve the dispute. All negotiations are confidential and shall be treated as compromise and settlement negotiations for purposes of applicable rules of evidence. Mediation. If a dispute has not been resolved by negotiation within 45 days of the first written notice of dispute sent from one party to the other party, the parties shall endeavor to settle the dispute by mediation within Denver County, Jefferson County, Douglas County, Arapahoe County, Adams County, Boulder County, Colorado, using the services of a mutually-agreeable mediator. This Agreement shall be governed by the laws of the State of Colorado. No Warranties. I understand that the success of Training depends on many factors outside the control of the Trainer, including each dog’s abilities, and the interests, commitment and cooperation of myself. Accordingly, I acknowledge that Dog Masters and Trainer make no warranties or guarantees that any dog will achieve any particular level of training. Media Consent. I further consent to use by Dog Masters of all photos and videos that may be taken of me, my family members and my dog(s) during Training for the purpose of training, publicity, advertising or other agreed-on purposes. I understand that I am fully financially responsible for any damages or harm caused by my dog(s) during a Training session, including training, socializing or walking. I represent that I am at least eighteen years of age and have authority to sign this Agreement.
